FLEEING OR ELUDING (Vehicular)

The state must prove that the defendant:

 

1.    Willfully refused or failed to stop.

2.    The officer had police insignia on his vehicle.

3.    Defendant was operating a vehicle.

4.    A duly authorized law enforcement officer ordered the defendant to stop or remain stopped.

5.    Defendant knew he had been directed to stop.
